Privacy notice

Last updated: 11 October 2026 · Version 1.3

This notice explains what personal data we collect when you use our free check, register your property, or contact us; why we collect it; and what rights you have over it.

We are not a firm of solicitors and do not provide reserved legal activities.

2. What we collect

If you use the free check: your name and email address, the postcode you enter, the property you select, and the answers you give about its condition, as well as whether you separately choose to receive updates. Technical data sent by your browser, including IP address, browser type and referring page. To prevent automated misuse, the application converts the network address into a keyed one-way identifier; it does not store the raw address in its rate-limit table.

If you register your property or contact us: your name, email address, property address and postcode, and anything you write in a message. The date, time and page on which you submitted it, and the consent wording shown to you, which we retain as our record of consent.

If you go on to commission a report: property characteristics including floor area, rooms, age, construction and condition; any valuation, banding notice or correspondence you receive from the Valuation Office Agency or HMRC; photographs, floorplans, surveys and EPCs where you provide them; and payment details, which are processed by our payment provider and not stored by us.

We also obtain data about properties from public and licensed sources, including HM Land Registry price paid data, Energy Performance Certificate records, the Valuation Office Agency's published lists, and licensed property analytics providers.

Service analytics. We record limited first-party journey milestones, such as a completed postcode lookup or displayed result, against a random internal submission reference. We also retain the page path and campaign tags attached to that visit. The analytics record does not contain your name, email address, property address or valuation result.

Special category data. We do not seek information about your health, finances beyond what a challenge requires, or other sensitive matters. Please do not send us sensitive information we have not asked for.

3. Why we use it, and our lawful basis

What we doLawful basis
Provide access to the free check and return an indicative estimateLegitimate interests in providing the service you requested
Email you updates about the surcharge and our serviceConsent, which you may withdraw at any time
Contact you when your banding is publishedConsent, or steps taken at your request before entering a contract
Prepare a comparable evidence reportPerformance of a contract with you
Keep records of work doneLegal obligation and legitimate interests in defending potential claims
Improve the accuracy of our modelLegitimate interests, using aggregated and de-identified data
Prevent fraud and secure our systemsLegitimate interests in operating a secure service

Where we rely on legitimate interests, we have considered whether our interest is overridden by your rights and concluded it is not. You may object at any time; see section 8.

4. Automated estimates and how decisions are made

Our free check compares your property against local sold prices and price per square foot for comparable homes, adjusted for the condition information you provide. This produces an indicative figure.

That figure is not a decision about you in a legal sense, and it does not determine your tax. Your banding is set by the Valuation Office Agency, not by us. Any report we produce is evidence and analysis, reviewed by a person before it is relied upon or submitted on your behalf.

We do not carry out solely automated decision-making producing legal or similarly significant effects within the meaning of Article 22 UK GDPR. You are entitled to ask how a figure for your property was arrived at, and we will explain it.

5. Who we share it with

We do not sell your personal data and we do not share it with advertisers or list brokers. We share it only:

  • With the Valuation Office Agency, HMRC, your local authority or the Valuation Tribunal, where necessary to pursue a matter on your instruction
  • With RICS valuers or other professionals we instruct on your case, with your prior authority
  • With service providers who process data on our behalf. Our email platform, website host, payment provider and property data suppliers are each bound by written contract to act only on our instructions
  • With our professional advisers, insurers and auditors, where genuinely required
  • Where we are legally obliged to disclose, including under a court order

Some providers may process data outside the UK. Where they do, we rely on UK adequacy regulations or on the International Data Transfer Agreement or Addendum.

6. How long we keep it

DataRetention
Free checker access detailsUntil 12 months after the final list is published, unless you ask us to delete them sooner or become a client
Email address held on consent aloneUntil you unsubscribe, or after 36 months of no engagement
Property registrations awaiting the VO's published listsUntil 12 months after the final list is published, then deleted unless you become a client
Case files where we acted for you6 years from conclusion of the matter
Records of consentFor as long as we rely on the consent, and 12 months afterwards
Financial and payment records6 years, as required for tax purposes
Security rate-limit identifiersSeven-day rolling expiry; stored only as keyed one-way hashes and removed on the next protected request
Website analytics26 months maximum

Because the surcharge timetable runs to 2028, property registrations are held longer than a typical mailing list. We will re-confirm your consent when the draft list is published.

7. Marketing

We email you only because you asked us to. Every email contains a one-click unsubscribe link. We will not pass your address to anyone else for their own marketing.

If you become a client, we may send service messages about your matter that are not marketing.

8. Your rights

You have the right to ask for a copy of your data; have inaccurate data corrected; ask us to delete data where we have no continuing lawful reason to keep it; ask us to restrict processing while a concern is resolved; object to processing based on legitimate interests; receive data in a portable format; and withdraw consent at any time.

To exercise any of these, email info@MansionTaxChecker.co.uk. We respond within one month and do not charge a fee unless a request is manifestly unfounded or excessive.

If you are unhappy with how we have handled your data, please tell us first. You also have the right to complain to the Information Commissioner's Office at ico.org.uk/make-a-complaint or on 0303 123 1113.

9. Cookies

This site sets only cookies that are strictly necessary for it to function. We do not use advertising cookies or cross-site tracking. Our first-party journey measurement uses existing service records and does not set an analytics cookie. If that changes, we will update this notice and ask for your consent first.

10. Security

We hold your data on access-controlled systems, encrypted in transit and at rest, with access limited to those who need it. We will notify you and the ICO of a personal data breach where the law requires it.

11. Changes to this notice

The surcharge and its appeals process are still being finalised in legislation. We may update this notice as the scheme develops. We will post the revised version with a new date, and where changes materially affect you we will tell you by email.
